In one such case, an employer tried to escape the payment of commission to a deserving employee. As per the law the plan was turned and the employer wasn't required to pay any future wage claims. High employee turnover was considered as the main factor behind this ruling. The employer formed a plan wherein it was decided to pay quarterly commissions on sales, provided the employee was working during the quarterly payment period.

According to the Division of Labor Standard Enforcement it was decided that wages would be calculated includes commissions on sales as well. But, under another law it was ruled that the entire due wage amount to be paid twice every month. The rule was followed by lot of confrontation and seemed unacceptable with the existing law. Though, the plan didn't result in forfeiture of commissions and wasn't considered to be a compliant, because it didn't provide payment of wages twice a week.

We all know that a knowledgeable attorney proves quite beneficial for business to stay out of trouble. Similarly, a labor attorney can help employees for their wages and overtime lawsuits. Therefore, finally it was decided not pay commissions where the orders were canceled. The law also read that “at times its permissible to require that the contract upon which the commissions are based is not complete until payment of the contract price to the employer.”

According to the Labor Code Section 204, it was decided that all the commissions earned on sale must be paid within it due time and any withholding for more than 3 month would mean violation of the law. It was also decided that all earned commissions cant be fortified. Having said this, it may be noted that the law also prevents an employer from writing off commissions which otherwise, would have been earned by discharging the employee before those commissions vest.
